Two police officers in Fullerton, Calif., have been ordered to stand trial for the death of Kelly Thomas, a 37-year-old mentally ill homeless man.
Thomas died in July 2011 from injuries sustained during a violent arrest by six Fullerton officers, part of which can be seen in the video below.
Fullerton police officer Manual Ramos approached Thomas while responding to a call that someone was peering into cars at the town bus depot.
Surveillance video at the depot was running during the incident, and officer Ramos was also recorded by a device he was wearing on his uniform.
Synced together, the audio and video formed the key evidence shown in court during a preliminary hearing to decide whether to try the officers.
Kelly Thomas, who is shirtless and sporting a full beard the night of the arrest, was a well-known fixture at the bus depot before that night.
In the video, Manual Ramos approaches him and tells him repeatedly to extend his feet in front of him and to put his hands on his knees.
After several minutes, the tape shows a visibly annoyed Ramos putting on latex gloves and, using expletives, threatening Thomas with his fists.
The confrontation escalates, and Thomas is seen trying to run from Ramos, who hits him with a baton. Soon after, another officer assists Ramos.
Thomas apologized and insisted that he can’t breathe. In all, six officers tried to subdue Thomas, who is heard in the recording crying for help.
Thomas fell into a coma and died five days later after being taken off life support. Kelly’s father, Ron, says the recording is too difficult to watch.
The judge reviewing the evidence this week halted proceedings as audience members gasped and cried out as the video was screened.
Ron Thomas says those haunting cries have pushed him to seek justice for his son.
For weeks last year, dozens of supporters rallied in front of Fullerton’s police headquarters demanding that the officers be prosecuted.
Under pressure, the chief of police took a leave of absence, then resigned, and three City Council members have been targeted for recall.
Orange County D.A. Tony Rackauckas personally presented the case and took the extraordinary step of charging Ramos with second degree murder.
Officer Jay Cicinelli faces lesser charges, including involuntary manslaughter.

‘We decided to not play by the rules,’ Adam Levine says of the band’s upcoming clip, which features Wiz Khalifa.

When it came time to think up a treatment for “Payphone,” the first single off Maroon 5′s upcoming Overexposed album, frontman Adam Levine knew exactly what he wanted … he also knew there would be some occupational hazards involved in getting his way.
“The video is this crazy thing; it’s about a bank robber, it was actually an idea that I had, and Sam Bayer, who’s a brilliant director is doing it,” he told MTV News on the “Payphone” set. “I work at a bank and I wear these glasses that are really a bit creepy and maybe make me look like a child molester. It’s a real go-for-it, swing-for-the-fences video, I get brave and I steal a gun from one of the guys and try to be a bad-ass, which is weird, because I’m not a badass.”
And from his mind to an actual bank vault in Los Angeles, the “Payphone” video is shaping up to be a pretty epic clip … not to mention everything Levine imagined.
“I love to write video treatments; I would actually professionally write treatments. I don’t even want to direct anything. I just love coming up with outlandish, fun things that I’ve always wanted to do,” he said. “I don’t think they’ll be able to play it on MTV actually, because there’s guns in it. Maybe they’ll have to blur the guns out. But we decided to kind of not play by the rules, as far as the typical video goes; I’m sick of seeing just a band playing a song in a video, I think it’s fun to try to do something far more different.”
Of course, doing something different also means lining up none other than Wiz Khalifa to guest on the track, especially since, on Overexposed Levine said the band maintained a strict “no guests” approach (especially given the success of the Christina-Aguilera-guesting hit “Moves Like Jagger”). Though, with the song completed and the video shot, Levine says he’s glad the band bent the rules to get Khalifa.
“Wiz is an amazing dude, and he’s just the future. He’s already so huge, but he hasn’t really done many big pop records, actually, so just the idea that he’d be interested in doing it was enough to get him involved. It was too good to pass up,” he said. “He’s a wonderful guy, he’s so creative and so quick … watching him in the studio, he was just so in it, within 30 minutes he had this incredible verse and he’d already knocked it out. That dude is really prolific and really talented.”

Rovio has announced that in 2011, it made a huge $106.3 million turnover and a whopping $67.6 million in profit (before tax), showing that flinging feathery fowl is a very serious business. Fueled by the success of Angry Birds, Seasons and Rio, the company grew by a factor of eight in the last year, from 28 employees all the way to 224. The company adds that the three games were downloaded 648 million times and are now used by 200 million daily users, while sales of merchandise contributed to around 30 percent of the total revenue. The report adds that the only barrier to future profits is if people stop buying new smartphones, but we’re not sure that’s likely to be the case for a while.

TOKYO (AP) ? Thousands of Japanese marched to celebrate the switching off of the last of their nation’s 50 nuclear reactors Saturday, waving banners shaped as giant fish that have become a potent anti-nuclear symbol.
Japan will be without electricity from nuclear power for the first time in four decades when the reactor at Tomari nuclear plant on the northern island of Hokkaido goes offline for routine maintenance.
After last year’s March 11 quake and tsunami set off meltdowns at the Fukushima Dai-ichi plant, no reactor halted for checkups has been restarted amid public worries about the safety of nuclear technology.
“Today is a historical day,” Masashi Ishikawa shouted to a crowd gathered at a Tokyo park, some holding traditional “koinobori” carp-shaped banners for Children’s Day that have become a symbol of the anti-nuclear movement.
“There are so many nuclear plants, but not a single one will be up and running today, and that’s because of our efforts,” Ishikawa said.
The activists said it is fitting that the day Japan is stopping nuclear power coincides with Children’s Day because of their concerns about protecting children from radiation, which Fukushima Dai-ichi is still spewing into the air and water.
The government has been eager to restart nuclear reactors, warning about blackouts and rising carbon emissions as Japan is forced to turn to oil and gas for energy.
Japan now requires reactors to pass new tests to withstand quakes and tsunami and to gain local residents’ approval before restarting.
The response from people living near nuclear plants has been mixed, with some wanting them back in operation because of jobs, subsidies and other benefits to the local economy.
Major protests, like the one Saturday, have been generally limited to urban areas like Tokyo, which had received electricity from faraway nuclear plants, including Fukushima Dai-ichi.
Before the nuclear crisis, Japan relied on nuclear power for a third of its electricity.
The crowd at the anti-nuclear rally, estimated at 5,500 by organizers, shrugged off government warnings about a power shortage. If anything, they said, with the reactors going offline one by one, it was clear the nation didn’t really need nuclear power.
Whether Japan will suffer a sharp power crunch is still unclear.
Electricity shortages are expected only at peak periods, such as the middle of the day in hot weather, and critics of nuclear power say proponents are exaggerating the consequences to win public approval to restart reactors.
Hokkaido Electric Power Co. spokesman Kohei Ofusa said Saturday’s shutdown was proceeding as planned. Power generation was gradually being reduced, with all operations expected to end at 11 p.m. (1400 GMT), he said.
Yoko Kataoka, a retired baker who was dancing to the music at the rally waving a small paper Koinobori, said she was happy the reactor was being turned off.
“Let’s leave an Earth where our children and grandchildren can all play without worries,” she said, wearing a shirt that had, “No thank you, nukes,” handwritten on the back.
